General Terms and Conditions

Article 1 – Definitions

In these general terms and conditions the following terms are understood to mean:

Entrepreneur: Sim Publishing, based in the Netherlands.
Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement with the entrepreneur.
Agreement: any agreement concluded between the entrepreneur and the consumer via the webshop.
Products: all physical products offered by Sim Publishing, including books, posters, cards, games, and other creative publications.
Personalized products: products that are specially adapted at the request of the consumer, such as name, color, text, or customization.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every agreement concluded between the entrepreneur and the consumer.

  2. Before the agreement is concluded, the text of these terms and conditions is made available to the consumer.

  3. Deviations from these terms and conditions are only valid if agreed upon in writing.


Article 4 – The offer

  1. Every offer is without obligation. The entrepreneur is entitled to modify or adjust the offer.

  2. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

  3. The offer contains as complete and accurate a description of the offered products as possible, so that the consumer can properly assess the offer.

  4. Images, specifications, dimensions, colors, and other data are for illustrative purposes only. No rights can be derived from them.

  5. Variations in color or finish may occur due to screen settings or printing techniques.

  6. If a product is produced or personalized specifically for the consumer, the final result may differ slightly from the example.


Article 5 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.

  2. The entrepreneur confirms receipt of the acceptance electronically.

  3. The entrepreneur shall take appropriate technical and organizational measures to secure the electronic transmission of data.

  4. The entrepreneur may, within legal frameworks, investigate whether the consumer is able to meet their payment obligations. If there are valid reasons, an order may be refused or subject to additional conditions.


Article 6 – Prices

  1. All listed prices are in euros and include VAT, unless otherwise stated.

  2. Any shipping costs will be clearly stated before completing the order.

  3. Obvious errors or mistakes in the offer do not bind the entrepreneur.


Article 7 – Payment

  1. Payment must be made via the payment methods offered on the website.

  2. The consumer is obliged to report inaccuracies in payment details without delay.

  3. In the event of late payment, the entrepreneur is entitled to charge the legally permitted costs.

  4. Refunds will be processed using the same payment method used for the original payment, unless otherwise agreed.


Article 8 – Delivery and execution

  1. The entrepreneur will execute orders with care.

  2. The place of delivery is the address provided by the consumer.

  3. Orders will be executed within the agreed timeframe, but no later than 30 days, unless otherwise agreed.

  4. The risk of damage or loss rests with the entrepreneur until the moment of delivery to the consumer.


Article 9 – Right of withdrawal (non-personalized products)

  1. The consumer has the right to terminate the agreement without giving reasons within 14 days.

  2. The cooling-off period starts on the day after the consumer, or a third party designated by him, has received the product.

  3. During the cooling-off period, the consumer must handle the product with care.

  4. The costs of return shipping are the responsibility of the consumer, unless otherwise agreed.

  5. Following a correct cancellation, the full purchase amount will be refunded within 14 days, provided the product has been received or proof has been provided that it has been shipped.


Article 10 – Exclusion of the right of withdrawal (personalized products)

  1. In accordance with Article 6:230p of the Dutch Civil Code, the right of withdrawal is excluded for products manufactured according to the consumer's specifications and which are not prefabricated.

  2. This includes personalized name posters and other custom-made products.


Article 11 – Conformity and warranty

  1. The entrepreneur guarantees that the products comply with the agreement and with reasonable requirements of soundness.

  2. Slight differences in color or size within reasonable margins shall not be considered a defect.

  3. The statutory warranty does not affect any additional warranties.


Article 12 – Liability

  1. The liability of Sim Publishing is limited to the amount of the relevant order.

  2. The entrepreneur is not liable for indirect damage, such as consequential damage or lost profits.

  3. This limitation does not apply in cases of intent or gross negligence on the part of the entrepreneur.


Article 13 – Force Majeure

  1. The entrepreneur is not obliged to fulfill obligations in the event of force majeure.

  2. Force majeure is understood to mean any circumstance beyond the control of the entrepreneur, including disruptions at suppliers, transport problems, government measures, and technical malfunctions.


Article 14 – Intellectual property

All designs, texts, images, and other materials are protected by intellectual property rights and may not be used or reproduced without permission.


Article 15 – Complaints Procedure

  1. Complaints must be reported in writing via info@simpublishing.com within a reasonable period, but no later than two months after discovery. .

  2. The entrepreneur confirms receipt of the complaint within 14 days.

  3. The consumer can also file a complaint via the European ODR platform:

Article 16 – Applicable law and disputes

  1. All agreements are governed exclusively by Dutch law.

  2. Disputes shall be submitted to the competent court in the Netherlands.


Article 17 – Amendments

The entrepreneur reserves the right to amend these general terms and conditions. The most recent version shall always apply.


All designs, illustrations, layouts, texts, concepts, and products of Sim Publishing are protected by copyright. It is expressly prohibited to copy, reproduce, distribute, commercially exploit, or imitate in any way any products, designs, or parts thereof without the prior written consent of Sim Publishing.

In the event of infringement of intellectual property rights, Sim Publishing reserves the right to take legal action and recover any damages.
